About this Giveaway

The SPIKA Christmas Giveaway is run and managed by SPIKA Limited (who we’ll refer to as ‘us’, ‘we’ and ‘our’ in these terms and conditions).

It is open to anyone aged 18 and over (except for our employees and their immediate family) who have been sent the Christmas Card Giveaway email. By entering this Giveaway, you (who we’ll refer to as “you” or “entrant” hereafter) agree to be unconditionally bound by these terms and conditions, and you confirm that you are eligible to enter and to claim the Item.

If you do not agree with these terms and conditions, please do not enter the Giveaway.

The Giveaway opens on Monday 12 December 2022 at 09:00 GMT and closes on Friday 13 January 2023 at 01:00 GMT (the “Submission Period”). We can suspend, end or cancel the Giveaway at any time at our sole discretion without liability.

Entering the Giveaway

No purchase is necessary to enter in this Giveaway. To enter the Giveaway, simply click on the ‘yes, I’d like to know more about Spotlight neon’ button to be entered into a draw to have a chance to win.

We will disqualify anyone we suspect of any kind of cheating, deception, or fraud, even if they enter via a third party. This includes any kind of manipulation whatsoever. If we do not enforce this, it does not mean we have given up the right to do so. The Giveaway is subject to all applicable laws and regulations. It shall be deemed void where prohibited.

What you are agreeing to if you enter

By entering this Giveaway, you agree to have read, understood and accepted these Terms and Conditions.

The Items

The Giveaway Items consist of one of the following items:

A Cheese Slicer or a Neon branded bottle.

Thor Bjørklund has not endorsed this Giveaway and are in no-way connected to SPIKA Limited or its Employees.

There shall be one Item per Entrant. There is no cash alternative for the Item save that we may offer to donate the equivalent purchase price to a charity nominated by SPIKA. The receipt by the Entrants of the Item shall be conditioned by compliance with all applicable laws. Every effort will be made to ensure the Entrant does not receive any additional Charges relating to Customs, Vat, Taxes or Import. In the event the Entrant is asked to pay additional fees the Entrant should contact SPIKA who will make the payment on behalf of the Entrant or reimburse the Entrant for fees paid.

Acceptance and Delivery of the Item

Each Entrant must indicate to us the address where the Item is to be sent. Delivery is included in the Item including customs charges where necessary.

How we will use your information

Your personal data including your name, address and contact details (“Personal Data”) which you have provided to us as part of you entering in this giveaway will be recorded, stored or otherwise processed by us for purposes relating to the administration and conduct of the Giveaway and for sending the chosen product to the Entrants and our other legitimate business purpose (“Purpose”).

In accordance with data protection legislation, we collect personal data you have used to enter the Giveaway and to contact and notify the entrants only. No data will be passed on or sold to third parties save for enabling us to run the Giveaway and to remit the Items to the Entrants.

You will only be giving your personal information to us (and, if necessary, to people working on our behalf). Please be informed that your Personal Data may be disclosed to relevant service providers for the Purpose and as permitted by applicable data privacy laws.

We might process your personal information outside of the UK. We will keep your personal data only as necessary for permitting the Entrants to benefit from the Items.

You may request for access to or correction of the Personal Data or limit the processing of the Personal Data at any time hereafter by submitting such request to us. Please send such requests to privacy@spika.com

Please note that it will be necessary for you to provide your name and your address without which we will not be able to process sending the Items to the Entrant.

SPIKA will delete data stored, for the purposes of fulfilling the christmas gift giveaway, before the end of March 2023.

Legal Disclaimer

You agree to assume all risk involved by entering in this Giveaway. By entering the Giveaway, you agree to indemnify, release and hold harmless SPIKA Limited from any liability, damages, losses or injury resulting in whole or in part, directly or indirectly, from your entry in the Giveaway and the acceptance, use or misuse of any Item that may be received. As a condition for entering, you hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, and you further waive all rights to have damages multiplied or increased.

The Giveaway is limited to one order per person.

We reserve the right, in our sole discretion, to cancel, terminate, modify or suspend this Giveaway at any time and at our discretion. In particular but not limited to, we may cancel terminate, modify or suspend this Giveaway, should any virus, bug, non-authorized human intervention, fraud, or other cause beyond the our control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway.

We reserve the right to modify these Terms and Conditions and the Items awarded at any time without prior notice. We also reserve the right to cancel this Giveaway at our sole discretion without any liability to the entrants. Our decision is final with respect to any aspect of the Giveaway, including without limitation, modifications to these Terms and Conditions, cancellation of the Giveaway, the method of selection as well as the determination of the Entrant(s).

We do not make any warranties, express or implied, as to the condition, fitness or merchantability of the Items. We disclaim all liability for damage pursuant to participation in this Giveaway.

You agree to be bound by these Terms and Conditions. Entrants shall have no recourse against us in case this Giveaway is cancelled, or the Item is not received. No refund or compensation will be made in the event of the cancellation or in case the Items is not received.

Any dispute relating to the Giveaway shall be governed by the laws of England and Wales and will be subject to the exclusive jurisdiction of the English courts.
